1. Acceptance of these terms
These Terms & Conditions (“Terms”) govern your use of https://ijava-website.vercel.app (the “Site”), iJava Cafe’s in-store services, catering services, and the iJava Coffee Club membership program. By using the Site, signing up for the Coffee Club, placing a catering order, or otherwise interacting with our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.
iJAVA Cafe LLC(“iJava,” “we,” “us,” or “our”) operates the Site and the services described here. These Terms form a binding agreement between you and us.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to create a Coffee Club membership or submit a catering inquiry. By doing so, you represent that the information you provide is accurate, that you are legally authorized to use the payment method submitted at checkout, and that your use of the Site complies with applicable laws.
3. The iJava Coffee Club
The Coffee Club is a recurring monthly subscription that entitles each member to one (1) free drip coffee per weekday (Monday through Friday), redeemable in person at iJava Willow Glen, 2306 Almaden Rd #150, San Jose, CA 95125. Redemption requires presentation of your member QR code at the counter. The membership does not apply on Saturdays or Sundays.
One membership per person. Memberships are personal, non-transferable, and may not be shared, resold, or assigned. Your QR code is yours alone. We may suspend or terminate a membership we reasonably believe is being shared or misused.
What’s included. One drip coffee per weekday — any size, hot or iced. Espresso drinks, lattes, specialty pours, refills, and food are not included. Unredeemed days do not carry over.
Billing. The Coffee Club is billed monthly in advance at the then-current price (currently $20.00 USD per month). Your card is automatically charged on the recurring billing date until you cancel. All charges are non-refundable except where required by law.
Cancellation by you. You may cancel at any time by calling (415) 374-3059, emailing info@ijavacafe.com, or telling us at the counter. Cancellation takes effect at the end of your current billing period; we do not pro-rate partial months. You may continue to redeem your daily coffee until the period ends.
Cancellation by iJava; right to refuse service. We reserve the right, at our sole discretion and at any time, with or without notice, to refuse service to any person and to suspend, terminate, or decline to renew any membership, including without limitation for: (a) violation of these Terms; (b) suspected or actual sharing, fraud, or misuse of a membership or QR code; (c) abusive, threatening, harassing, or unlawful conduct toward our staff or customers; (d) chargebacks or payment failures; or (e) any other reason we deem appropriate in our reasonable judgment. Cancellation under this section may occur without refund of fees already paid, including any portion of the current monthly period.
4. Pricing and changes
Coffee Club pricing, included benefits, redemption locations, and other program terms may change from time to time. If we increase the monthly price or change a material term that affects current members, we will give you advance notice by email to the address on your account before the change takes effect. You may cancel before the change takes effect if you do not wish to continue at the new price. Continued use of the membership after the effective date constitutes acceptance of the new price or terms.
5. Payment processing
Payments are processed by Stripe, Inc. (“Stripe”), a PCI-DSS Level 1 certified payment processor. When you check out, your card information is submitted directly to Stripe over an encrypted connection; iJava does not see, receive, or store full card numbers, CVCs, or expiration dates. Stripe’s use of your payment information is governed by Stripe’s own terms and privacy notice, available at stripe.com. By submitting a payment method, you authorize iJava and Stripe to charge that payment method for the recurring fees described in these Terms.
6. Information we collect and how we use it
When you sign up for the Coffee Club or submit a catering inquiry, we collect information you provide, such as your name, email address, phone number, mailing address, and the contents of your inquiry. We also automatically collect limited technical information when you visit the Site, such as IP address, device and browser type, and pages viewed.
We use this information to: provide and fulfill the services you request; issue and email your member QR card; send transactional messages such as receipts, renewal notices, service updates, and replies to inquiries; prevent fraud and abuse; comply with legal obligations; and operate, maintain, and improve the Site.
Full details on data collection and handling are described in our Privacy Policy, which is incorporated into these Terms by reference.
7. Third-party services and analytics
We use trusted third-party service providers to operate the Site and deliver our services. These currently include Stripe (payment processing), Supabase (database and storage), Resend (transactional email delivery), and Vercel (web hosting). We may also use privacy-respecting analytics tools to understand how the Site is used. We share with these providers only the information they need to perform their services on our behalf, and each is contractually required to protect that information.
We do not sell your personal information. We may disclose information when required by law, to respond to lawful requests from public authorities, to enforce these Terms, or to protect the rights, property, or safety of iJava, our customers, or others.
8. Communications consent
By providing your email address and/or phone number, you consent to receive transactional and service-related communications from iJava at those contact points, including your welcome email, member QR card, receipts, renewal and payment notices, cancellation confirmations, and replies to inquiries you send us. You may opt out of non-essential marketing communications at any time by replying to any such message or by contacting us at info@ijavacafe.com. We may still send you transactional messages necessary to operate your membership or fulfill a request.
9. Acceptable use
You agree not to: use the Site or services in violation of any law; interfere with or disrupt the Site or its security features; attempt to gain unauthorized access to any system or account; impersonate any person; harvest or scrape information; or use the services for any fraudulent or commercial resale purpose. We may investigate and take any action we deem appropriate in response to a violation.
10. Intellectual property
The Site and its contents — including text, graphics, logos, photographs, menus, designs, and software — are owned by or licensed to iJava and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any portion of the Site without our prior written permission, except for personal, non-commercial use.
11. Disclaimer of warranties
The Site and services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, iJava disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components.
12. Limitation of liability
To the maximum extent permitted by law, iJava and its owners, employees, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or relating to your use of the Site or services. Our total aggregate liability for any claim arising out of or relating to these Terms or the services will not exceed the greater of (a) the amounts you paid to iJava in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
13. Indemnification
You agree to defend, indemnify, and hold harmless iJava and its owners, employees, and affiliates from and against any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site or services, your violation of these Terms, or your violation of any rights of a third party.
14. Governing law and venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. The exclusive venue for any dispute arising out of or relating to these Terms or your use of the services will be the state and federal courts located in Santa Clara County, California, and you consent to the personal jurisdiction of those courts.
15. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date at the top of this page and, for Coffee Club members, we will notify you by email. Your continued use of the Site or services after the changes take effect constitutes acceptance of the updated Terms.
